Mobile Message (SMS) Terms and Conditions

The following terms and conditions apply to your use of any of the services that Ensequence provides that results in you receiving a text (SMS or MMS) message, including any Ensequence Mobile Message Campaign Program and any associated abbreviated dial code, application or content (each, a “Service”).  If you sign up for or use any Service provided by Ensequence, you are agreeing to comply with and be bound by the following terms and conditions, which together with our privacy policy govern Ensequence’s relationship with you in relation to your use of the Service.  The terms ‘Ensequence,’ ‘us,’ and ‘we’ refer to Ensequence, Inc., with an office at 420 Lexington Avenue, Suite 408, New York NY 10170.  The term ‘you’ refers to the user of any Service.  The following terms and conditions apply to all Services:

 
Acceptance by You

By opting in to use any Service, you are authorizing Ensequence to deliver text messages to any mobile device for which you provide us a telephone number.  You are also certifying that you are the account holder for the number provided or have the account holder’s permission to opt in to the Service.

 

You must be 18 years old or older to use any Service.  Anyone between the ages of 13 and 18 may access the Service, but only with the express permission of their parent or guardian.

 
Sign Up to Receive Promotional Text Messages

You may sign up for an Ensequence Mobile Message campaign by texting the keyword listed below to 78166:

  • The first time you sign up (opt into) a Service, you will receive a confirmation text message followed by one or more additional messages.  If a Service involves more than one message, you will be advised about the number and frequency of messages involved in the Service.

 
Is this a free service?

This service is free from Ensequence but your carrier may charge you Messaging and Data charges for each message you receive from us according to your carrier’s terms of service.  By accessing a service, you are agreeing to pay all such charges. Message & Data Rates may apply.

 
What if I don’t want to receive any more SMS text messages?

To stop receiving SMS text messages from us, simply text STOP to 78166. Additionally you may send an email to support@ensequence.com containing the telephone numbers at which you no longer wish to receive text messages or call 1-888-488-2112. We will remove your mobile number from our subscription lists.

 

Once your telephone number is removed from our system, you will receive a final confirmation message and no further messages will be sent to your mobile device unless you re-enroll in a Service by opting-in as described above.

 
What if I want more information?

You can request more information about an Ensequence Mobile Messaging campaign by texting HELP to 78166, sending an email to support@ensequence.com, or calling 1-888-488-2112.

 
Requirements

To take advantage of an Ensequence Mobile Messaging Service, you must have a text messaging-enabled mobile device with a text messaging plan.

Limitation of Liability

By using any Service, you agree that under no circumstances will Ensequence be liable to you for any damages arising out of or relating to that Service, including any incidental, special or consequential damages (such as lost profits or lost business opportunities), punitive damages or attorney’s fees.  You further agree that all damages that may be recoverable from us will be limited, at most, to $1.

 

Ensequence is not responsible and will not be liable in any way for any delays you may experience sending or receiving messages.
